We follow the 70-year rule for artists, meaning that we only do "inspired by" art for artists who have been dead for more than 70 years and whose artwork has gone into the public domain.

Copyrights of Others

At Abstract Rebellion, we create original AI-generated artworks using open source AI art generation technology, which we fine tune for our needs. While the training data used for this model may have included some copyrighted images, our use of it to produce new artworks constitutes fair use under copyright law for the following reasons:

1. Our AI-generated images are transformative works that do not simply replicate original copyrighted artwork but combine and reinterpret elements from the training data in novel ways to create unique artistic compositions.
2. The artworks we generate using our open source model incorporate our creative input through the prompts and guidance we provide, making each piece an original expression distinct from the training sources.
3. Our use of the open source model does not diminish the value of or act as a substitute for any preexisting copyrighted works potentially included in their training set. Our AI artworks serve a different artistic purpose.
4. The commercial sale of our transformative AI artworks does not negate the fair use consideration, as our works do not merely reproduce copyrighted material for the same intent and market as the original works.

Therefore, we firmly assert that Abstract Rebellion's use of open source model to create and sell new, transformative AI generated artworks falls within the bounds of fair use, even if our open source model's training data contained some copyrighted material. We aim to create original, transformative artworks that do not intentionally infringe on any copyrights, but rather expand the realm of creative expression through the innovative capabilities of AI art generation technology.

However, we take copyright infringement claims seriously. If a copyright owner believes their work was used to train the AI models we use,
they may submit a valid notice to us with evidence of the alleged infringement.

Suppose a copyright owner believes that one or more of the artworks we offer for sale infringes their copyright. In that case, they may submit a takedown notice with evidence of the alleged infringement. We will review such notices in good faith and remove any works determined to be infringing.

Every artwork we offer is a new, original work generated through a creative AI process initiated by a human artist and then curated by a human artist. No artwork is a copy or reproduction of any existing work. However, in keeping with artistic traditions, some works may evoke the style or themes of existing artists without replicating any specific copyrighted work. We believe this artistic inspiration and influence constitute fair use.

Integrity and Transparency

We are transparent about the fact that all the artworks we sell are AI-generated. We do not sell AI-generated works deliberately intended to be counterfeits, forgeries, or plagiarized copies of existing artworks. This style provides a modern, sleek look where the image continues onto the edges of the canvas.  Stretched canvases have four edge options: white, black, mirror-wrapped, and image-wrapped.  On mirror image-wrapped canvases, a mirror image of the original design starts at the edge outer edges of the frame.  On image-wrapped canvases, the original artwork wraps around the corners.
